Terms of Service
These terms govern your use of The Club, a recreational golf pool application available at theclub.locker and through its iOS app (the "Service"). By creating an account or using the Service you agree to them.
1. Eligibility and accounts
You must be at least 18 years old. During the beta, accounts are created by invitation only. You are responsible for activity on your account and for keeping your email access secure, since sign-in codes are delivered by email. One account per person.
2. What the Service is (and is not)
The Club provides scorekeeping, drafting, standings, chat, and recordkeeping tools for private golf pools organized by their own members. The Club is not a gambling or betting service. It is not a sportsbook or daily fantasy operator; it does not offer, facilitate, process, or accept wagers; and it never collects, holds, escrows, transmits, or distributes money. Any financial arrangement among pool members, including buy-ins and payouts the Service helps record, is made privately between members, outside the Service, at their sole discretion and responsibility. Members are responsible for ensuring their participation complies with the laws of their jurisdiction.
3. Pools and commissioners
Pools are run by their commissioners, who control pool settings, membership, tiers, pick rules, and money records. The Club is not a party to any pool and does not arbitrate disputes between members, though we may correct data errors caused by the Service itself.
4. Acceptable use
Keep it between friends. You may not use the Service to harass or defraud others, to post unlawful content in pool chat, to attempt unauthorized access to accounts or data, to scrape or resell the Service, or to violate any applicable law. We may remove content or suspend accounts that break these rules.
5. Your content
You own what you post (display name, avatar, messages, picks). You grant us the license needed to operate the Service: to store, display, and transmit that content to the members of your pools. Delete your account and this license ends, along with the content, as described in the privacy policy.
6. Sports data
Live scores, rankings, and player data come from third-party providers and may be delayed, incomplete, or wrong. Standings compute from the data we have. The Service is not affiliated with or endorsed by the PGA Tour or any tournament, player, or data provider named in it.
7. Fees
The Service is currently free. If that ever changes, we will say so clearly before anything is charged.
8. Termination
You can stop using the Service or delete your account at any time. We may suspend or terminate accounts that violate these terms, and we may discontinue the beta or the Service itself with reasonable notice.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. This is a beta: expect rough edges, downtime, and changes.
10. Limitation of liability
To the maximum extent permitted by law, The Club and its operator are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or amounts owed between pool members. Our total liability for any claim relating to the Service is limited to one hundred dollars ($100) or the amount you paid us in the past twelve months, whichever is greater.
11. Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in San Francisco County, California.
12. Changes
We may update these terms as the Service evolves. Material changes will be called out in the app, and continued use after a change means you accept it.
